Court Appointed Counsel

Under Penal Code Section 987.2, the County is obligated to pay the costs associated with the representation of indigent defendants. Defendants are first referred to the Public Defender. When the representation of a defendant by the Public Defender results in a conflict of interest, or for any other reason the Public Defender cannot accept a case, the Alternate Public Defender (APD) performs a similar review. Should the APD be unable to represent an indigent defendant, then outside counsel must be appointed.

Qualifications

The qualifications document sets forth eligibility requirements to apply for a criminal indigent defense panel, such as:

  • general membership eligibility
  • suspension, reclassification, and removal
  • grounds for suspension, removal and other disciplinary action
  • attorney classifications (death penalty, felony, and misdemeanor attorney grades).

Billing Guidelines

Appointed counsel billing guidelines for the criminal division are created for the County of Solano, the Superior Court of Solano County and the private attorneys appointed by the Court to represent indigent criminal defendants, sets forth procedures for submitting billings. This packet of information includes the criminal Billing Guidelines, relevant forms and outlines how to submit your claims for payment.

Billing Instructions

  • Completed Vendor Claim and Claim and Order for Compensation of Court Appointed Attorney located below.
  • Itemized Invoice indicating the number of service hours, dates and services provided.
  • Original signature on the Vendor Claim and Order for Compensation forms must be in blue ink.
  • Send the below forms original and one copy of each (Vendor Claim, Order and Invoice with original receipts) – no staples please to the Fiscal Services Division as listed below.
