General Information and Confidentiality

The Juvenile Court is responsible for handling matters regarding minors. The judges in Juvenile Court hear delinquency cases involving minors charged with violations of the law and dependency cases involving minors who have been neglected or abused. Juvenile Traffic Officers hear matters related to traffic offenses committed by minors. Juvenile citations are processed and paid through the Probation Department at (707) 784-7631.

Confidentiality

Only persons with a legal right to do so may receive information regarding juvenile cases, such as a parent or legal guardian of the minor. Juvenile matters require a resonal appearance with proper photo identification. Information regarding Juvenile matters is confidential and cannot be given over the phone.

If you believe you have good cause to review a juvenile's records you must file a Request for Disclosure of Juvenile Case File. See procedure below.

Request for Disclosure of Juvenile Case File (formerly called Petition for Disclosure of Juvenile Records)

This procedure is handled pursuant to Welfare and Institutions Code Section 827. There is no filing fee for the Request for Disclosure of Juvenile Case File, Notice of Request for Disclosure of Juvenile Case File, and Proof of Service on Request for Disclosure of Juvenile Case File. The requesting party should also include a blank copy of the Objection to Release of Juvenile Case File (form JV 572) and the Orders on Request for Disclosure of Juvenile Case File (form JV 573 and form JV 574). The Request for Disclosure of Juvenile Case File (form JV 570), Notice of Request for Disclosure of Juvenile Case File (form JV 571), Proof of Service on Request for Disclosure of Juvenile Case File (form JV 569), Objection to Release of Juvenile Case File (form JV 572), Order on Request for Disclosure of Juvenile Case File (form JV 573) and Order After Judicial Review (form JV 574) are Judicial Council forms. These forms may be obtained from the Juvenile Division of the Solano County Superior Court, by clicking on the links provided in this description, or from the Judicial Council's online website at www.courtinfo.ca.gov/forms.

Once the Request for Disclosure of Juvenile Case File, the Notice of Request for Disclosure of Juvenile Case File, and Proof of Service on Request for Disclosure of Juvenile Case File are filed with the Juvenile Court Clerk's office, they are submitted to a Juvenile Court judge for review. The judge must review the request and the Court's file before deciding whether to grant the request. The judge can grant, deny or set a hearing on the request.

If the judge orders a hearing on the request or denies the request, the Juvenile Court Clerk will mail a copy of the Order on Request for Disclosure of Juvenile Case File (form JV 573) to the appropriate parties. If the matter is set for hearing, the order will contain the court date, time and department. If the Request for Disclosure of Juvenile Case File is granted, the Judicial Assistant will photocopy the records to be released.

The clerk will also mail endorsed filed copies of the Order After Judicial Review (form JV 574) allowing the release of records to the apropriate parties. Back to Top

Juvenile Delinquency

Delinquency cases are criminal in nature, alleging violations of the law by persons under 18 years of age. Proceedings are filed pursuant to Welfare & Institutions Code Section 602.

Delinquency cases can result in long-term probation, out of home placement in a group home or youth facility, or even commitment to the California Department of Corrections and Rehabilitation, Division of Juvenile Justice (DJJ).

Juvenile Dependency

Dependency cases are initiated when children have been abandoned, neglected or abused by someone while in their parents', guardian's or custodian's care, or cases where parents are unable or unwilling to care for their children.

Dependency cases can result in long-term foster care, guardianship proceedings, or termination of parental rights and adoption by a caring family. Dependency cases are filed pursuant to Welfare & Institutions Code Section 300. (Most juveniles in delinquency cases and parents in dependency cases are eligible for Court-appointed attorneys if they cannot afford their own attorneys.)

Truancy Court

Truancy Court for minors- 7th to 12th grade

Truancy cases are filed by Probation when a minor is habitually truant.

A minor is considered truant when they have developed a pattern of being absent three or more days at a time wihtout a valid excuse or are repeatedly more than 30 minutes late to three or more school periods a day.

The matter is referred to the Juvenile Court after the school has exhaused their attempts to meet with the student and his/her parent or guardian to correct the behavior. A police officer may also cite the minor to appear before the judge.

If a minor is deemed habitually truant the judge can revoke or delay the minor's driver's license for a period of one year.

Truancy Court for parents

When a minor kindergarden through sixth grade is habitually truant, the parent is cited to appear by their local police agency and the citation is forwarded to the District Attorney for review. When the District Attorney determines that a Petition should be filed, it is filed and placed on calendar by the Traffic Division. Cases cited out of Fairfield, Suisun, Vacaville, Dixon and Rio Vista (North County) are heard in Fairfield on the first and third Wednesday at 1:30 p.m. Cases cited out of Vallejo and Benicia (South County) are heard in Vallejo on the second and fourth Monday at 3:00 p.m.

When a minor seventh grade through twelfth grade is habitually truant, the parent is cited to appear by their local police agency and the citation is filed directly with the court in the Traffic Division. Cass cited out of Fairfield, Suisun, Vacaville, Dixon and Rio Vista (North County) are heard in Fairfield on Thursday at 11:00 a.m. Cases cited out of Vallejo and Benicia (South County) are heard in Vallejo on Tuesday at 3:00 p.m.

The majority of juvenile paperwork is prepared and filed by the District Attorney, Public Defender, Probation Department and Child Services Division (Department of Health and Social Services) or the attorney for a party.
